New York City railroad accidents

New York City railroad accidents happen more often than you might expect.  Unfortunately, if a pedestrian or a motor vehicle has a collision with a train, the results will almost certainly be tragic.  The responsibility for the accident can be the pedestrian or operator of the motor vehicle.  It is also possible for the train engineer, railroad, or other party to be liable for the railroad accident.  Sometimes crossings are substandard, in disrepair, or not secured by crossbars.  The ability of an approaching vehicle to see an oncoming train may be obscured by a stopped train as well.    

Of course, you do not have to be a pedestrian or in a motor vehicle to be involved in a railroad accident.  If you were a passenger on a train, your right to compensation for any injuries you sustained may be even more clear-cut.  As a general rule, a common carrier may be liable for personal injuries to passengers.  Railroad companies, as a common carrier, are required to use the highest degree of care, diligence, and vigilance in the transport of its passengers to their destination.
